Terms of Service
Effective Date: June 1, 2025
These Terms of Service (“Terms”) govern your access to and use of the websites, online team stores, digital platforms, and services operated by BRUCE BOLT TEAMS, LLC (“BRUCE BOLT TEAMS,” “we,” “us,” or “our”), including the purchase of custom uniforms, apparel, and related products (collectively, the “Services”).
By accessing our website, submitting a design request, opening a team store, or placing an order with BRUCE BOLT TEAMS, you agree to be bound by these Terms. If you do not agree, you must not use our Services.
1. Scope and Applicability
1.1 Platform.
These Terms apply to your use of the BRUCE BOLT TEAMS website(s), online team stores, digital tools, and any other online or offline Services we make available (collectively, the “Platform”).
1.2 Agreement.
These Terms form a legally binding agreement between you (an individual user, coach, parent, organization, or school) and BRUCE BOLT TEAMS regarding your access to and use of the Platform and any orders for goods and services placed through it.
1.3 Updates to Terms.
We may update these Terms from time to time. The version in effect at the time you place an order or use the Platform will apply to that transaction or use. Material changes will be posted on the Platform with an updated effective date.
2. Description of Services
2.1 Custom Team Apparel.
BRUCE BOLT TEAMS designs, sells, and distributes custom uniforms, apparel, and related gear for youth clubs, schools, and other organizations, including but not limited to:
- Sublimated jerseys and pants
- Training gear and fan apparel
- Hoodies, quarter-zips, and accessories
- Online team stores for group ordering
2.2 Design Collaboration.
We work with teams and organizations to create custom looks that reflect their identity. This may include:
- Design consultations
- Use of customer-submitted logos and artwork
- Integration of sponsor names, marks, and other branding
2.3 No Guarantee of Availability.
We may add, change, or discontinue products, features, and services at any time without notice.
3. Eligibility, Accounts, and Authorized Use
3.1 Minimum Age.
You must be at least 16 years old to place an order or use our Services for commercial or organizational purposes. If you are under 18, you must have consent and authorization from a parent, guardian, or authorized representative of your organization.
3.2 Organization Authority.
If you are placing an order or opening a team store on behalf of a team, league, school, or club, you represent and warrant that you have the authority to bind that organization to these Terms.
3.3 Account Information.
When you create an account or place an order, you agree to provide accurate, current, and complete information, including contact details, shipping address, and payment details. You are responsible for keeping your information up to date.
3.4 Account Security.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
3.5 Prohibited Use.
You may not use the Platform:
- For any unlawful or fraudulent purpose
- To infringe any third party’s intellectual property rights or privacy rights
- To upload or transmit malicious code, spam, or harmful content
- If you have previously been suspended or banned from using our Services
We may suspend or terminate your access at our discretion for any violation of these Terms.
4. Products, Representations, and Variations
4.1 Product Descriptions.
We make reasonable efforts to display accurate descriptions, specifications, and images of our products on the Platform. However, all weights, measurements, and similar descriptions are approximate.
4.2 Color and Appearance.
Colors and finishes may appear differently on different screens or devices. While we aim for consistency, we cannot guarantee that the color displayed on your device will exactly match the final printed product.
4.3 Customization Variations.
Because products are custom-made, minor variations in color, placement, and scale (within commercially reasonable tolerances) do not constitute defects.
5. Customization, Artwork, Logos, and Sponsor Marks
5.1 Customer-Provided Content.
You may provide BRUCE BOLT TEAMS with logos, artwork, names, numbers, color specifications, and other content (“Customer Content”) for use on uniforms, apparel, and marketing materials related to your order.
5.2 Your Rights and Warranties.
By submitting Customer Content, you represent and warrant that:
- You own the Customer Content or have all necessary rights, licenses, and permissions to use it for the intended purpose.
- Your use and our use of the Customer Content will not infringe or misappropriate any third party’s intellectual property, publicity, privacy, or other rights.
- You have obtained all necessary consents from players, parents/guardians (for minors), sponsors, and other stakeholders for the use of names, numbers, logos, and marks on uniforms and associated promotional materials.
5.3 License to Use Customer Content.
You grant BRUCE BOLT TEAMS a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, and display Customer Content solely for:
- Creating design proofs and mockups
- Producing and fulfilling your orders
- Operating your team store and processing re-orders
- Internal recordkeeping, quality control, and portfolio/sample purposes
Any broader marketing use (e.g., featuring your team prominently in brand campaigns) will be subject to our Media & Marketing provisions in Section 13 and any opt-out elections you make.
5.4 Right to Decline Content.
We may, in our sole discretion, decline or request modification of Customer Content that:
- Appears unlawful, offensive, or discriminatory
- Contains protected trademarks, team names, or celebrity likenesses for which you cannot demonstrate rights
- Violates league, school, or governing body rules
If we decline certain elements, we may request alternative content or remove those elements from the final design.
5.5 Indemnity for Customer Content.
You agree to defend, indemnify, and hold harmless BRUCE BOLT TEAMS from and against any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to:
- Alleged or actual infringement or misuse of intellectual property rights related to Customer Content
- Use of player names, numbers, images, or likenesses without proper consent
- Use of sponsor logos, trademarks, or brand assets without proper permission
6. Orders, Quotes, and Acceptance
6.1 Requesting Quotes and Mockups.
Design requests, quotes, and digital mockups are for planning purposes only and do not create a binding contract until an order is formally placed and accepted.
6.2 Placing Orders.
Orders may be placed through online team stores, purchase forms, or directly with our sales team. By placing an order, you are making an offer to purchase the products subject to these Terms.
6.3 Order Acceptance.
A binding contract for the sale of goods (“Sales Contract”) is formed when we issue an order confirmation (e.g., via email) or otherwise indicate acceptance of your order. We may refuse or cancel any order, in whole or in part, at our discretion, including if:
- The product is unavailable
- Payment authorization is declined
- There are apparent errors in pricing or description
- Shipping or fulfillment limitations apply
If we cancel any portion of an order after payment, we will refund the applicable amount.
6.4 Final Approvals.
For custom products, you may be required to approve final artwork and/or rosters. Your approval (including via email or online tools) constitutes acceptance of all design details and personalization. Production will proceed based on your final approved information.
7. Pricing, Taxes, and Payment
7.1 Pricing.
Prices are shown in U.S. Dollars unless otherwise specified. We may change prices at any time; however, the price applicable to an order is the price in effect at the time the order is placed and accepted.
7.2 Taxes and Fees.
Applicable sales, use, or other taxes and shipping charges will be calculated and displayed at checkout or in your invoice. You are responsible for all such charges.
7.3 Payment Terms.
Payment methods are those listed on the Platform or agreed with our sales team. Unless otherwise stated in writing, payment is due in full at the time of order placement or as specified in an invoice or contract.
7.4 Non-Approved Payment Methods.
We are not responsible for losses arising from the use of unapproved or unofficial payment channels.
7.5 Invoices.
Where required by law or deemed appropriate by us, we may issue electronic invoices, which you agree to accept.
8. Production, Shipping, and Delivery
8.1 Lead Times.
Custom production and delivery timelines are estimates only and may vary based on seasonality, approvals, and logistics. Typical custom uniform delivery windows are communicated during the ordering process but are not guaranteed deadlines.
8.2 No Guarantee of Deadline.
While we strive to meet requested in-hand dates (e.g., start of season, tournament dates), exceeding an estimated delivery window does not entitle you to compensation, cancellation of completed work, or other damages, except where otherwise required by law.
8.3 Shipping Charges and Methods.
Shipping options and charges will be disclosed during checkout or in your invoice. Title to the goods passes to you upon shipment. Risk of loss passes to you when the goods are delivered to the carrier.
8.4 Delivery Addresses.
We deliver to the address you provide. You are responsible for ensuring the accuracy of that address and for receiving the shipment.
8.5 Partial Shipments.
We may ship orders in multiple installments as products are completed. Partial shipments do not incur additional shipping charges unless specifically requested by you.
8.6 Failure or Inability to Deliver.
If, after formation of a Sales Contract, we become unable to deliver due to circumstances beyond our reasonable control, we may cancel all or part of the order and will refund any amounts paid for undelivered goods.
9. Returns, Errors, and Cancellations
9.1 Custom Nature of Products.
Most BRUCE BOLT TEAMS products are custom-made based on your approvals, rosters, and design selections. For this reason, custom items are generally not eligible for return, exchange, or refund, except in cases of our error or manufacturing defects.
9.2 Defects or Errors.
If you believe an item is defective or does not match the approved design or order details, you must notify us in writing within 14 days of delivery, with photographs and a description of the issue. We may, at our discretion:
- Repair or replace the affected items; or
- Offer a partial credit or other reasonable solution
9.3 Non-Returnable Items.
Items that are correctly produced according to your final approvals, size selections, and order details are not returnable due to sizing issues, color perception on screens, or changes of preference.
9.4 Order Cancellation.
You may request cancellation of an order prior to:
- Team store closure (for store-based orders), and/or
- The order entering production
Once production begins on custom items, orders cannot be canceled. Any permitted cancellation may be subject to design fees or other costs already incurred.
10. Intellectual Property
10.1 Our IP.
All content on the Platform, including designs, logos, trademarks, graphics, text, images, and software, is owned by or licensed to BRUCE BOLT TEAMS and is protected by intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works based on such content without our prior written consent.
10.2 Branding and Marks.
“BRUCE BOLT TEAMS” and any associated names, logos, and taglines are trademarks or service marks of BRUCE BOLT TEAMS. Nothing in these Terms grants you any rights in those marks other than the limited right to use products you purchase for their intended purpose.
10.3 Use of Platform.
We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for legitimate organizational and consumer purposes in accordance with these Terms.
11. Subcontracting and Assignment
11.1 Our Rights.
We may subcontract, assign, transfer, or otherwise delegate any of our rights or obligations under these Terms and any Sales Contract, provided your rights are not materially adversely affected.
11.2 Your Rights.
You may not assign or transfer your rights or obligations under these Terms or any order without our prior written consent.
12. Disclaimers and Limitation of Liability
12.1 As-Is Basis.
Except as expressly stated in these Terms or as required by law, the Platform and all products are offered “as is” and “as available” without warranties of any kind, whether express or implied.
12.2 No Indirect Damages.
To the fullest extent permitted by applicable law, BRUCE BOLT TEAMS will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost opportunities, or lost goodwill, arising out of or related to:
- Use or inability to use our products or Platform
- Delays in delivery
- Errors in Customer Content or approvals
12.3 Liability Cap.
To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or related to the Services or any order will not exceed the amount actually paid by you for the specific order giving rise to the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless BRUCE BOLT TEAMS and its officers, directors, employees, agents, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the Platform or products
- Your violation of these Terms
- Your breach of representations or warranties (including regarding Customer Content)
14. Media and Marketing Use
14.1 General Use.
We are proud of the teams we serve. From time to time, we may capture or receive photographs, videos, or images of players and teams wearing BRUCE BOLT TEAMS products (“Media”).
14.2 Scope of Use.
Unless you opt out as described below, you grant us a non-exclusive, royalty-free license to use such Media for promotional and marketing purposes, including:
Our website, social media, and digital marketing
- Lookbooks, catalogs, and sales materials
- Presentations and trade events
14.3 Opt-Out.
If you or your organization do not want your team Media to be used, you must notify us in writing at media@bruceboltteams.com with sufficient detail to identify the team/organization. We will make commercially reasonable efforts to honor your request on a going-forward basis.
15. Data Privacy
15.1 Privacy Policy.
Your use of the Platform and our handling of personal information is governed by our Privacy Policy, which is incorporated by reference into these Terms.
15.2 Compliance.
We handle personal data in accordance with applicable data protection laws, including, where applicable, GDPR and CCPA/CPRA, as described in our Privacy Policy.
16. Force Majeure
We will not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to acts of God, war, terrorism, labor disputes, supply chain disruptions, governmental actions, natural disasters, or failures of carriers, utilities, or communications.
17. Governing Law and Dispute Resolution
17.1 Governing Law.
These Terms and any disputes arising out of or related to them or any Sales Contract will be governed by the laws of the State of Texas, USA, without regard to its conflict of law principles.
17.2 Venue.
You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you hereby consent to the personal jurisdiction of such courts.
18. Changes to These Terms
We may revise these Terms at any time by posting an updated version on the Platform. Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.
